Offices of BMBLR and relevant enterprises:
With the aim to further regulate land development and utilization behaviors in real estate market, reinforce supervision lawfully, and pursuant to the requirements of the Notice on Reinforcing Real Estate Land Use Supply and Supervision of Relevant Issues (Guo Tu Zi Fa [2010] No. 34) formulated by the Ministry of Land and Resources (MLR), relevant issues concerning the implementation of declaration and information publicity system for the development and utilization of state-owned construction land in our city are hereby notified as follows:
I. From April 1, 2010, any land use right holder who has signed the Contract on Assignment of State-owned Construction Land Use Right (excluding those who are currently applying for a supplementary assignment registration) shall declare, in written form, the development and utilization status for the use of construction land to BMBLR upon the commencement and completion of the project constructed on the parcel stipulated in the Contract.
BMBLR will publicize any land use right holder who failed to follow the declaration system, and will suspend the right holder from participating in any land purchase activities for at least 1 year.
II. In the case that the land use right holders signed the Contract on Assignment of State-owned Construction Land Use Right or the Contract on Assignment of State-owned Land Use Right before April 1, 2010 (excluding those who are currently applying for a supplementary assignment registration), and the project constructed on the parcel stipulated in the Contract is not completed yet, the land use right holder shall declare, in written form, the commencement and completion dates of the project constructed on the parcel stipulated in the Contract to BMBLR.
In the case that the land use right holders signed the Contract on Assignment of State-owned Construction Land Use Right or the Contract on Assignment of State-owned Land Use Right during the period from January 1, 2007 to March 31, 2010 (excluding those who are currently applying for a supplementary assignment registration) and the project constructed on the parcel stipulated in the Contract has been completed already, the land use right holders are also required to declare the actual project commencement and completion dates in written form to BMBLR prior to May 31, 2010.
III. In the case where the project hadn't commenced after one year's delay to the date stipulated in the assignment contract by April 1, 2010, the land use right holders shall report, in written form, the reasons for delay to BMBLR prior to May 31, 2010.
IV. From April 1, 2010, if a project hasn't commenced, completed within the terms as stipulated in assignment contract, the land use right holders shall report, in written form, the reasons for delay to BMBLR within 15 days prior to the expiry of the assignment contract.
V. For projects with assignment contract signed by and between land use right holder and BMBLR, the declaration shall be made at the official document window in BMBLR; for those with assignment contract signed by and between land use right holder and district and county-level offices of land and resources, the declaration shall be made at the official document windows in corresponding land and resources office.
VI. When declaring, the Declaration Form for the Development and Utilization of Construction Land shall be filled up; corresponding materials shall also be submitted as per different situations:
a) A copy of Construction Project Execution Permit or other commencement certificate (with official seal); on-site pictures.
b) A copy of completion certificate (with official seal); on-site pictures.
c) Explanatory documents and relevant proofing materials for the delay of commencement or completion.
d) Other related materials required by land and resources authorities.
The Declaration Form for the Development and Utilization of Construction Land can be downloaded from the website of BMBLR (www.bjgtj.gov.cn).
VII. After verifying and processing the contents declared by a land use right holder in accordance with contract terms and conditions, land and resources authorities can make provisions and supervision on the land use by means of signing a supplementary agreement with the land use right holder.
VIII. The utilization of allocated land shall also be declared under the provisions of this Notice.
