Matters Relating to Enterprises' Application for the Employment License for Foreigners
 

I. Materials required for the application for the Employment License for Foreigners by enterprises

1. The original and a photocopy of the business license of the enterprise legal entity (duplicate), the certificate of approval, the articles of association and the joint venture operation contract;
2. A written application for the employment of the foreigner (explaining in detail the reasons for the employment and the position to be appointed, affixed with the official seal of the employer); 
3. The intention or agreement of employment for the foreigner to be employed (a board resolution should be attached for the employment of a foreigner filling the position above the rank of deputy general manager);
4. The Chinese curriculum vitae and the credentials of qualifications of the foreigner to be employed (the original and a photocopy of the academic degree certificate, the professional skills qualification certificate and the credentials of over two years of relevant work experiences of the foreigner to be employed are required);
5. A photocopy of the valid passport of the foreigner to be employed;
6. A photocopy of the health certificate of the foreigner to be employed issued by a foreign medical institution recognized by the Chinese embassy or consulate in the concerned country or issued by the health and quarantine department designated by the Chinese government;
7. An Application Form for the Employment of Foreigners (with the official seal affixed to the applicant signature/seal line) and a recent passport-size photo of the foreigner to be employed;

II. Time limit for handling: 10 working days. 

III. POINTS OF ATTENTION:

1. Handling person should take a letter of introduction from his/her employer and his/her own personal ID document (in the case where an agent is entrusted to handle the application formalities, a power of attorney and a photocopy of the business license (duplicate) of the entrusted agent should be also submitted) and the relevant documents to the office window to complete the application formalities;
2. Provided that the submitted academic degree certificate or the credentials of qualifications are in a foreign language, their Chinese translation bearing the official seal of a professional translation company should be provided;
3. Domestic companies which intend to employ foreigners should submit the original and a photocopy of their social insurance registration certificate;
4. Foreign or domestic law firms which intend to employ foreigners or residents of Hong Kong, Macao and Taiwan should have a valid certificate issued and sealed by the Beijing Bureau of Justice as well as the valid documents required above to apply for the Employment License for Foreigners(/overseas persons);
5. The Beijing branch of the out-of-town enterprises which intend to employ foreigners should submit a photocopy of the business license (duplicate) of their head office, a photocopy of their certificate of approval and the original and a photocopy of their own business license;
6. A board resolution needs to be submitted for the foreigner who is to be appointed to a position above the rank of deputy general manager. Where the applying enterprise does not have a board of directors, it shall submit a resolution signed by the person in charge as specified in its articles of association;
7. The Employment License for Foreigners shall be valid within six months from the date of issue, and shall be invalid after the specified time limit.
